Application for a Variation to a Premises Licence - AP Wines, Fenny Stratford To consider Item 5. Additional documents:
Minutes: The Senior Licensing Officer advised the Sub-Committee that a hearing had been necessary to determine an objection from Thames Valley Police against an application for a variation to a Premises Licence for AP Wines, 26 Watling Street, Fenny Stratford, Milton Keynes, MK2 2BL. The application had been for an additional three hours trading every night with proposed opening hours extended to the same: Existing Hours for Alcohol Supply Monday to Sunday 08:00 to 23: 00 hours Proposed Hours for Alcohol Supply Monday to Sunday 08:00 to 02:00 hours During the statutory consultation, a representation had been received from Thames Valley Police, as a Responsible Authority. S Rajithakumar (Applicant) informed the Sub-Committee they had been struggling to compete with other licensed premises within the vicinity; customers had requested they open later; the intention had not been just to increase the sale of alcohol but to offer postal / Paypoint services; additional members of staff would be present until the premises closed; and they had not had any issues with the Police or Licensing Authority since their licence had been granted in June 2022. The Applicant had understood the conditions from Thames Valley Police and had offered additional conditions to be added to the licence, if granted. G McCormack (Thames Valley Police) informed the Sub-Committee the concerns raised which primarily related to the extension of hours for the sale of alcohol; the premises had been close to four other licensed premises; one of which had been Pink Punters with opening hours permitted until 01:00 hours, Monday to Wednesday, and 07:00 hours, Thursday to Sunday; and the impact to nearby residents and businesses. The Police had welcomed the additional proposed conditions from the Applicant. In reaching its decision, the Sub-Committee took account of the evidence presented by both the Licensing officer and Responsible Authority; together with the evidence put forward by the Applicant. RESOLVED - The Sub-Committee resolved to grant the variation application, subject to the following conditions and restrictions: 1. Opening Hours 07:00 hours to 00:00 hours, Monday to Sunday 2. Sale of Alcohol 08:00 hours to 00:00 hours, Monday to Sunday 3. That the following conditions be added to the licence: (a) that the Premises Licence Holder creates and maintains a risk assessment to determine a suitable number of staff to be present on site when the shop is operating between 23:00 and 00:00 hours. The risk assessment will be updated on an annual basis and will consider incidents that have occurred over the past twelve months; (b) that additional customer signage be displayed to encourage respectful behaviour of patrons when leaving the premises; (c) that rubbish not be taken out of the premises after 23:00 hours; (d) that a Challenge 25 Policy and a staff training manual be implemented; and (e) that there should always be two members of staff on the shop floor between the trading hours of 22:00 hours and 00:00 hours. 4.
