Review of Local Planning Policy Documents and the Development Brief Protocol pdf icon PDF 119 KB

Decision:

1.         That, further to completion of the reviews, following consideration in accordance with Regulation 10a of the Town and Country Planning (Local Planning) Regulations 2012, it be noted:

(a)        Plan:MK (2019), the Site Allocations Plan DPD (2018) and Statement of Community Involvement (2020) are up to date and consistent with national planning policy; and

(b)       a New City Plan is being prepared to replace Plan:MK and the Site Allocations Plan DPD, as outlined in the Local Development Scheme (2023).

2.         That an updated Statement of Community Involvement (attached at Annex G to the report) be agreed with the following amendments:

(a)        removal of ‘Annex A Planning Policy Consultation during COVID-19’; and

(b)       factual changes to reflect national planning policy references.

3.         That a formal update of both the Minerals Local Plan (2017) and Waste DPD (2008) be commenced.

4.         That, in respect of the Protocol on preparing Development Briefs for MKDP and other Council owned sites:

(a)        the issues set out in Annex H to the report be noted; and

(b)       authority be delegated to the Director of Planning and Placemaking, in consultation with the Leader of the Council), to revise and republish the protocol, reflecting a voluntary process that is led by the landowner.

Decision:

1.         That the commencement of a procurement exercise using the NEPO 507 Travel Management Service Framework Agreement for the purpose of:

(a)        hotel accommodation for Adult Services (temporary accommodation); and

(b)       travel and accommodation for children in care for Childrens Services. 

2.         That authority be delegated to the Director of Adult Services, in consultation with the S151 Officer, to award the contract.

8.

Waste Transfer Station Refurbishment pdf icon PDF 127 KB

Decision:

1.         That the commencement of a procurement process for the design and conversion of the Waste Transfer Station, using either PAGABO or RE:FIT, be approved.

2.         That authority be delegated to the Director of Environment and Property, in consultation with the Cabinet member for Resources, to approve the final framework to be used for this procurement, subject to:

(a)        completion of required due diligence/carbon assessment; and

(b)       the Council’s ability to remain compliant with procurement law by use of the chosen framework including the process of contract award.

3.         That authority be delegated to the Director of Environment and Property to subsequently approve the award of the design and refurbishment contract providing the award is within the approved resource allocation.

That approval to commence the procurement process for the design and conversion of Linford Wood Place, using the PAGABO National Refit and Refurbishment Framework be granted.

Energy Supply Contracts from October 2024 to 2028 pdf icon PDF 138 KB

Decision:

1.         That Milton Keynes City Council continues to use the LASER Energy Buying Service framework contracts to procure gas (reference Y22008), electricity and associated metering supplies (reference Y22009) from
1 October 2024 for a period of four years.

2.         That authority be delegated to the Director of Environment and Property, in consultation with the Director of Finance and Resources and the Cabinet member for Resources, to make the final arrangements for the supply from the LASER Framework, including:

(a)        the scope of delivery over the term of the framework agreement; and

(b)       consultation or other appropriate arrangements (as required) with tenants and leaseholders of the Housing Revenue Account (HRA), schools and other current users of the existing contract.  

3.         That appropriate consultation be undertaken, and that authority be delegated to the Director of Environment and Property, in consultation with the Director of Law and Governance, to confirm the most optimal route for both HRA tenants and leaseholders.

Milton Keynes Waste Recovery (MKWRP) - Re-procurement and Energy Programme pdf icon PDF 149 KB

Decision:

1.         That the public and press be excluded from the meeting by virtue of Paragraph 3 (Information relating to the Financial or Business Affairs of the Authority) of Part 1 of Schedule 12A of the Local Government Act 1972, in order that the meeting may consider exempt Annexes A to I to the report.

2.         That the variation of the contract for the Residual Waste Treatment Facility as summarised in the draft Deed of Variation (DoV) Heads of Terms (exempt Annex A) be approved, including the following key changes:

(a)        revised catastrophic risks and insurance provisions;

(b)       increased Parent Company Guarantee of £10m; and

(c)        principles for a Power Purchase Agreement (PPA) for energy supply to the Council via a synthetic sleeving arrangement.

3.         That the principle of the Council entering into a Power Purchase Agreement (PPA) be approved, subject to the Director of Property and Environment, in consultation with the Director of Law and Governance and the Director of Finance and Resurces, satisfactorily:

(a)        undertaking further due diligence with regard to the financial regulation matters set out in paragraph 9 of exempt Annex F; and

(b)       agreeing the appropriate accounting treatment for the PPA arrangements.

4.         That authority be delegated to the Director of Environment and Property, in consultation with the Director of Finance and Resources (s151), the Director of Law of Governance (Monitoring Officer), and the Cabinet Member for Resources and / or the Cabinet Member for Public Realm to:

(a)        agree non-material amendments to the proposed Deed of Variation and Heads of Terms (exempt Annex A); and

(b)       finalise and enter into the Deed of Variation and any other necessary formal documents to effect the agreed position.

5.         That the principles and strike price for the synthetic electricity sleeving supply and reconciliation be agreed (exempt Annex C), noting a separate delegated decision (also on 19 March 2024), to supply electricity other than to the General Fund and Streetlighting and with contingency processes for the sleeved arrangement.

6.         That authority be delegated to the Director Environment and Property, in consultation with the Director of Finance and Resources (s151), the Director Law of Governance (Monitoring Officer), and the Cabinet Member for Resources and / or the Cabinet Member for Public Realm to:

(a)        engage with the market to ensure that the MKWRP as a commercial offer is sufficiently attractive to the market to drive the best value and risk partition for the Authority; and

(b)       undertake and agree a commercial model for the procurement for MKWRP within the scope identified to maximise best value through contesting a competitive procurement of the facility from the market incoprorating feedback garnered from the market testing exercise.

7.         That, subject to the completion of the required procurement governance (including a subsequent delegated decision) and the satisfactory completion of recommendation 1.6 (a) and (b), approval be granted to commence the procurement for a contractor to manage the MKWRP using a competitive dialogue procedure.

1.         That the public and press be excluded from the meeting by virtue of Paragraph 3 (Information likely to Reveal the Financial or Business Affairs of the Authority) of Part I of Schedule 12A of the Local Government Act 1972, when the meeting considers exempt Annexes A and C to the report.

2.         That the contract, with an initial term of eight years (with an option for the Council to extend the term for two further periods of two years each) be awarded to the tenderer who scored the highest in accordance with the Most Advantageous Tender evaluation identified in exempt Annex A.

3.         That authority be delegated to the Director of Environment and Property to make any necessary decisions of a non-material nature and within any legal constraints permitted under the procurement process that has been followed to facilitate the execution of the contract and to finalise arrangements for mobilisation of the services.

4.         That any recommendation to enact the available extensions within the contract be subsequently agreed by the relevant Cabinet member in sufficient time to allow for continued service delivery.
